What is Settlement?
Settlement grants individuals the right to live in the UK without a specific time limit. Those who have settlement do not need to extend their stay or meet additional conditions. They are free to study, work, and even apply for British citizenship.
Is Settlement Actually Indefinite?
While settlement is meant to be permanent, it can still be lost. The most common way for individuals to lose settlement is by being away from the UK for too long. It can also be revoked from an individual if obtained through a criminal activity or fraud.
How to Obtain Settlement on a Work Visa Route
Settlement requirements can be different depending on the immigration route. Work visa applicants typically fall into two categories, which are main applicants and dependants.
However, there are some work visas that are temporary and do not lead to settlement. Some include Temporary Work visas, the Seasonal Worker, and Youth Mobility visas. Time spent while an individual is on one of these routes usually does not count toward the continuous residence requirement for settlement.
Regardless of the visa route, there are some general requirements that all the applicants must meet.
When Can I Apply?
Most work visa routes lead to settlement after five years of residence (continuous). However, some routes offer faster paths. One of them is Global Talent visa holders, who are endorsed by prestigious organizations and can usually apply for settlement after three years.
What Happens After I Obtain Settlement?
Once settlement is obtained, individuals become free from immigration restrictions and can live and work in the UK without time limits.
