Changes to the EU Settlement Scheme

There are changes coming to the Immigration Rules in relation to EU citizens and their family members. These changes are coming into force on the 6th October 2021.

What are the main changes?

The changes are mainly in relation to joining family members. The first change applies to  applicants seeking indefinite leave to remain or enter as partners of EU citizens. From 6th October 2021 the requirement to not be in the UK as a visitor is going to be removed.

This change will be welcomed by many prospective applicants as the travel disruptions and restrictions due to Covid meant that many family members returned to the UK as visitors.

The next big change is to do with the definition of ‘relevant document’ This is a document that dependant relatives must have in order for the relationship to be recognised.

From 6th October 2021 the phrase will be removed and instead ‘family permit’ which was issued after the 30 June 2021 will confirm their qualification. This will make it much easier for dependants to prove the relationship.
