Introduction 

With the implementation of new SOC2020 occupational code standards and an increase in skilled worker pay requirements, the UK’s immigration system is about to undergo a major overhaul. Annex 2 of the paper “Workers and Temporary Workers: guidance for sponsors” contains details on this update, which will take effect on April 4, 2024. This update represents a significant change in the way Defined Certificate of Sponsorship applications and sponsor management are handled. 

Background 

The UK Home Office has adopted the Migration Advisory Committee’s recommendations, as seen by the shift to SOC2020 codes and the modification of wage thresholds. By making these adjustments, the sponsor management system will be brought up to date and will be in compliance with current salary regulations and occupational classifications. 

Key Dates and Deadlines 

The sponsor license application form and the sponsor management system will be temporarily unavailable from 7 p.m. on April 2, 2024, until 9 a.m. on April 4, 2024. This is a crucial changeover. The system will switch over to the new standards during this time. 

Impact on Defined Certificate of Sponsorship 

The Home Office has promised to complete as many applications for Defined Certificates of Sponsorship as it can by the deadline of April 2, 2024, at 7 p.m. Applications that are not completed by this deadline will be canceled, requiring a new application in accordance with the updated rules. 

Impact on Undefined Certificate of Sponsorship 

In order to be assigned before the deadline, Undefined Certificates of Sponsorship that are tagged as “ready to go” or “work in progress” need to be updated with the new SOC2020 code and satisfy the modified salary thresholds. 

Consequences of Failing to Assign Certificates Before the Deadline 

Defined Certificates of Sponsorship must be reapplied for in order to be used under the new system if they are not assigned by the deadline. In a similar vein, Undefined Certificates need to be renewed in order to be valid. 

Steps to Take Before the Changeover 

Sponsors should make sure that all Undefined Certificates are prepared for the changeover by adding the required code and salary modifications, and they should give first priority to assigning any outstanding Defined Certificates of Sponsorship. 

After the Changeover 

New applications must follow the modified codes and salary limitations as of April 4, 2024. Crucially, even if the application is submitted after the switch, certifications that were issued prior to the deadline will still be valid and handled in accordance with the current rules.
